This Switchboard Website Privacy Note ("Website Privacy Notice") privacy notice relates to Switchboard's publicly-accessible websites, not our developer products, services or our Connect portal. Capitalized terms used but not otherwise defined herein have the meanings set forth in Switchboard's Terms of Service (the "Terms").
We collect data that you give us when you complete web forms on our website, and we use that data for the reasons you gave it to us, like when you fill out a form to "Talk to Sales," we use that data so you can talk to the sales team. We also use cookies to collect data automatically about your use of our website or for advertising.
We generally share the data we collect from you with those outside of Switchboard if they are a service provider for Switchboard (and have to follow our instructions) or if we're legally required to share it with someone outside of Switchboard.
Your data is transferred to the U.S.

Below is a description of what data we gather from you as a visitor to our various publicly-accessible websites, which includes switchboard.live, joicaster.co, and other websites where this Website Privacy Policy is posted. Use of the term "website" herein shall mean to include all of Switchboards websites. Also, included below is a description of why we collect and how we use the data we collect on the Switchboard website. The Switchboard website does not include our Connect portal which you access by signing up for an account with Switchboard. In this notice, the words "our," "us," "we," and "Switchboard" refer to Switchboard Live Inc. and our affiliates (which includes any person or entity that controls us, is controlled by us, or is under common control with us, such as our subsidiary, parent company, or our employees).
Before you submit any information on or through the Switchboard website, please carefully review this notice. By using any part of the Switchboard website, you consent to the collection, use, disclosure and sharing of your information as further outlined below in this notice.
Information Collected
Data you give to us directly. On some places on the Switchboard website, you can fill in a web form to share your data with us directly, such as on our "Talk to Sales" page or on our "Talk to Support" page. We collect the information you provide in response to those web forms. Occasionally, we may also offer opportunities for you to share your data with us such as through a survey, to sign up for a newsletter, or to register for or receive details about an event we are sponsoring. If you participate in those surveys, sign up for a newsletter, or register for an event, we will collect the information you provide to us in doing so.

Data we collect from you automatically. When you visit the Switchboard website, we and our service providers acting on our behalf automatically collect certain data using tracking technologies like cookies, web beacons, and similar technologies. Other data collection tools may include local storage (e.g., Flash Cookies, HTML5), web beacons (e.g., pixel tags, clear GIFs), embedded script programming code, ETag identifier at URL, log file information (e.g., IP address), location data (e.g., GPS coordinates), device information (e.g., MAC address), and analytics information (e.g., Google Analytics).
How We Use Your Information
Data you give us directly. For data that you give to us directly through the "Talk to Sales" and "Talk to Support" pages, we will use that data to formulate a response to your inquiry and know how to get back to you with our response. Similarly, if you provide us information directly in response to a survey or when signing up for an event, we will use the data you provide for the reason that you provided it to us and for other purposes that we tell you about at the time when you provided that data.
Data we collect automatically. For data that we collect from you automatically through tracking technologies, we use this data to understand how visitors to the Switchboard website are using it and which pages and features of the Switchboard Site are most popular. This helps us understand how we can improve our website. In addition, tracking technologies are used to help improve the navigation experience on the Switchboard website. Other uses include improving our Services, marketing, implementing features you activate, and to conduct research to enhance our offerings, and to record your preferences to enhance your experience.
How We Share Your Information
Unless you give us your permission, we don't share data we collect from you with third parties, except as described below:
Third party service providers or consultants. We may share data collected from you on the Switchboard Site with third-party service providers or consultants who need access to the data to perform their work on Switchboard's behalf, such as a website analytics company or our third party advertising partners. These third party service providers are limited to only accessing or using this data to provide services to us and must provide reasonable assurances that they will appropriately safeguard the data.
Compliance with Laws. We may disclose your data to a third party if (i) we believe that disclosure is reasonably necessary to comply with any applicable law, regulation, legal process or government request, (ii) to enforce our agreements and policies, (iii) to protect the security or integrity of the Switchboard website or our Services, (iv) to protect ourselves, our other customers, or the public from harm or illegal activities, or (v) to respond to an emergency which we believe in good faith requires us to disclose data to assist in preventing a death or serious bodily injury. If Switchboard is required by law to disclose any of your data that directly identifies you, then we will use reasonable efforts to provide you with notice of that disclosure requirement, unless we are prohibited from doing so by statute, subpoena or court or administrative order. Further, we object to requests that we do not believe were issued properly.
Affiliates. We may share data collected from you from the Switchboard website with our affiliates. We all will only use the data as described in this Website Privacy Notice.
Business transfers. If we go through a corporate sale, merger, reorganization, dissolution or similar event, data we gather from you through our website may be part of the assets transferred or shared in connection with due diligence for any such transaction. Any acquirer or successor of Switchboard may continue to use the data we collect from you through our website as described in this Website Privacy Notice.
Aggregated or de-identified data. We might also share data collected from you from the Switchboard website with a third-party if that data has been de-identified or aggregated in a way that does not directly identify you.
We do not actively share your data with third-party advertisers unless you give us your written consent to do so.
Users Outside of the U.S.
Please note that when you visit the Switchboard website, your data may be sent to the U.S. and possibly other countries. We store data about Switchboard website visitors on servers located in the U.S., and we may also store this data on servers and equipment in other countries. The data protection and other laws of the U.S. and other countries might not be as comprehensive as those in your country. Irrespective of the foregoing, by providing your information, you understand that it may be transferred to our facilities in the U.S. and to those third parties with whom we share it as described in this Website Privacy Notice.
Switchboard employs appropriate mechanisms for cross-border transfers of personal data, as required by applicable local law. In addition, Switchboard continues to abide by the US-EU Safe Harbor Framework and the US-Swiss Safe Harbor Framework, as provided by the U.S. Department of Commerce and regarding the collection, use, and retention of personal information received from European Union member countries and Switzerland. Switchboard has certified that it adheres to the Safe Harbor Privacy Principles of notice, choice, onward transfer, security, data integrity, access, and enforcement. Children
We do not knowingly collect personal information online from children under the age of 13 without parental or guardian consent. Please contact us if you believe we may have collected such information without parental or guardian consent or other than in a manner authorized by law, and we will work to delete it.
Information Security
We use reasonably appropriate security measures to protect the security of your data both online and offline. These measures vary based on the sensitivity of the information that we collect, process and store and the current state of technology. Please note, though, that no website or Internet transmission is completely secure, so while we strive to protect your data, we cannot guarantee that unauthorized access, hacking, data loss or a data breach will never occur.
You are responsible for maintaining the secrecy of and not to disclose intentionally or inadvertently your user login and password; do not disclose your password to anyone else. Please notify us immediately of any unauthorized use of your account. In the event that any personal information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation and where appropriate, notify those individuals whose Information may have been compromised and take other steps, in accordance with any applicable laws and regulations.
Notice to California Residents
Switchboard does not currently respond to web browser's Do Not Track signals. You can learn more about Do Not Track here.
Residents of the State of California may request a list of all third parties to which we have disclosed certain personal information (as defined by California law) during the preceding year for those third parties' direct marketing purposes. If you are a California resident and want such a list, please contact us. For all requests, you must put the statement "Your California Privacy Rights" in the body of your request, as well as your name, street address, city, state, and zip code. In the body of your request, please provide enough information for us to determine if this applies to you. You need to attest to the fact that you are a California resident and provide a current California address for our response. Please note that we will not accept requests via the telephone, and we are not responsible for notices that are not labeled or sent properly, or that do not have complete information.
Links, Third Party Websites and Social Networking Sites
Our Online Services and communications may contain links to other websites that are not owned or controlled by us and SNS (collectively, "Linked Sites"). We are not responsible for the privacy practices, policies, notices or content of any Linked Sites, even if you link to them from our Services. This Website Privacy Notice does not apply to any Linked Sites. We have no control over the collection or use of information on any Linked Site. We encourage you to read and understand the privacy practices, policies, notices, and content of any Linked Sites that you visit.
Changes to this Website Privacy Notice
We may change our Website Privacy Notice from time to time. If we make changes, we'll revise the "Last Updated" date at the top of this notice, which will be the effective date of such changes, and we may provide additional notice such as on the Switchboard Site homepage. If we make any material changes to this notice, Switchboard will notify you of those changes through a notice on the Switchboard website or other reasonable means of communication, such as email. We will comply with applicable law with respect to any changes we make to this Website Privacy Notice.
Your Choices
Deletion, access, and changes to your data. To request deletion of, access to, or to make changes to data we've collected from you via the Switchboard Site, email us at privacy@switchboard.live. Please note that even if you request that we delete data we've collected from you, we may still retain data collected from you in an aggregated or anonymized form that does not identify you. We also will not delete your data if we are legally required to maintain it.
Promotional communications. If you are receiving promotional emails from us, you can choose to stop receiving those by following the unsubscribe/opt-out instructions in those emails. You can also opt-out by contacting customer support.
Cookies and tracking technologies. How you make choices about cookies, and other tracking technologies depend on the type of cookie or tracking technology being used. You may be able to opt-out of the automatic collection of some Information by referring to your web browser's or mobile device's options or settings menu. However, doing so may disable many of the portions, features, or functionality of our Online Services. For example, most web browsers automatically accept cookies, but you have the choice to set your browser to accept or reject cookies. Mobile devices. Certain features of our Services as used on mobile devices may require access to your device's media storage applications (e.g., to use a video in your image gallery). Although you may decide whether or not to use any of those features, on Android devices you grant us permission to access such features as part of the installation process. If you later decide to revoke that permission, you can do so by following the standard uninstall process and removing the Application from your device. Alternatively, on iOS devices, you can grant or revoke your consent at any time and prevent us from continuing to access your image storage applications by changing the settings on your device.
Location data. You may opt-out from allowing us to have access to your location data by adjusting the permissions in your mobile device, though some features of our Services may not function properly if use or availability of location data is impaired or disabled.
SNS. You have the option to disable Information collected through SNS connections at any time by logging into your Account or reviewing the appropriate settings from within your account settings on the applicable SNS.
Targeted advertisements. You can also opt-out of the collection of web viewing data for interest-based advertising and other applicable uses by certain companies. Information regarding your usage of the Online Services may still be collected for research, analytics, or internal operations purposes. We are not responsible for the effectiveness of any such opt-out options.
Data retention and deletion. If you completely delete all of your personal information, then your account may become deactivated, although your profile and any videos associated therewith will remain on our Services unless you have deleted them. Following termination or deactivation of your account, we may retain your personal information for backup, archival, or audit purposes, as well as to comply with laws, prevent fraud, resolve disputes, troubleshoot problems, assist with any investigations, enforce the Terms, and take other actions otherwise permitted by law.
Disputes
If you have a dispute with us relating to our privacy practices, please contact our customer support or email us at privacy@switchboard.live. Most disputes can be resolved that way. If we can't resolve our dispute that way, please see Section 17 (Agreement to Arbitrate) of our Terms of Service, which describes how disputes will be resolved between us. As described in that section, the American Arbitration Association (www.adr.org) will conduct the dispute resolution proceedings. Please be sure to review our Terms of Service, including Section 17, before you use any of our products and services.
